SMS Terms & Consent

This SMS Terms & Consent page describes how Wasatch Crest Holdings LLC ("Company," "we," "us," or "our"), operating as Utah Ski Parking Alerts ("Service"), collects consent for and delivers SMS text message notifications regarding ski resort parking availability.
Current status: Email alerts are active now. SMS delivery is temporarily pending carrier approval. Users can still opt in now and SMS alerts will activate automatically once approval is complete.
1. Program Description
Utah Ski Parking Alerts is a parking availability monitoring and notification service. When subscribed, users may receive automated SMS text messages alerting them to changes in ski resort parking availability. Messages are transactional in nature and relate solely to the user's configured parking watch preferences.
SMS alerts are available exclusively to users on paid subscription plans (Standard or Pro). Free-tier users receive email notifications only.
2. Opt-In & Consent
No user will receive SMS messages without providing prior express written consent. Consent is collected through the following multi-step process within the user's authenticated account:
- The user creates an account and subscribes to a paid plan (Standard at $7/mo or Pro at $15/mo).
- The user navigates to Settings within their account dashboard.
- The user enters their U.S. mobile phone number in E.164 international format.
- The user affirmatively checks a consent checkbox, which is unchecked by default, containing the following disclosure:

SMS notifications require a paid plan (Standard or Pro).

- The user clicks "Save" to complete the opt-in process.
By completing this process, the user provides prior express written consent to receive automated SMS text messages from Utah Ski Parking Alerts at the phone number provided. Consent is not a condition of purchase; the Service functions without SMS via email-only alerts.
A timestamped record of each user's consent is stored in our database for compliance and audit purposes.
3. Message Content
Each SMS alert is a transactional notification containing:
- The name of the ski resort with available parking
- The date on which parking became available
- A short link to the resort's booking page

4. Message Frequency
Message frequency varies based on your watch activity and parking availability changes. Frequency may increase during peak ski season. Users may receive multiple messages per day during high-demand periods, or no messages during periods of no change.
5. Rates & Charges
Message and data rates may apply. SMS alerts are delivered to U.S. mobile numbers only. The user is responsible for any charges imposed by their mobile carrier. Consult your carrier for details regarding your messaging plan.
6. Opt-Out
Users may revoke consent and opt out of SMS messages at any time through any of the following methods:
- Reply STOP: Text STOP (or STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT) in reply to any message. A confirmation will be sent and no further messages will be delivered.
- Account Settings: Disable SMS notifications or remove the phone number from the Settings page in the dashboard.
- Email: Send a request to hello@powderlogic.ai including the account email address.
Opt-out requests are processed immediately. Users may re-subscribe at any time by texting START to our notification number or by repeating the opt-in process described in Section 2.

8. Privacy & Data Protection
Phone numbers are encrypted at rest using AES-256 encryption and decrypted only at the time of message delivery. We do not sell, rent, share, or use phone numbers for marketing purposes. A hashed audit trail of consent actions (opt-in, opt-out) is maintained for regulatory compliance.

9. Compliance
This SMS program is operated in compliance with applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA), the Cellular Telecommunications Industry Association (CTIA) Messaging Principles and Best Practices, and applicable Federal Communications Commission (FCC) rules. Our messaging platform is provided by Twilio, Inc.
